YCW`s Pre-Construction Services Agreement (General Contractor) is designed to engage a contractor to perform prefabrication services through a two-step tendering process. A CAAP is indeed a form of consultant appointment, and many of the key provisions of the CAAP follow this analogy, such as.B. the obligation to provide the services with the level of skill, care and diligence expected of a contractor who has experience in projects of similar size, scope and complexity. Ideally, these services should be integrated into the main contract after the completion of the construction period in order to obtain one-off liability, facilitate the identification of the contractor`s area of responsibility and, if necessary, provide rights to third parties. The agreement covers the period from the submission of tenders in the first stage to the submission of a final tender in the second stage and the completion of a main contract for the construction phase. Elsewhere, there are standard obligations regarding competence and diligence, prohibited materials, insurance, confidentiality and collaboration with the project team.
